Trial Court Budget Update
On June 15th, 2009, the Legislature came to agreement on a variety of funding and savings measures to offset the $393 million in cuts the Trial Courts are currently facing.  The framework of solutions is below.
Money to offset the cuts:
$130 million in funding from money redirected from IT/CCMS, SB 1407 (construction funds), and other funds controlled by the AOC.
 Court security fee increases for $40 million.
 Court Reporter user fee increase in civil proceedings for $7 million.
 Redirection of AB 509 funding in lieu of civil filing fee increase for $11 million.
Total NEW funding to offset cuts = $188 million
This leaves $205 million in cuts still on the table.  The Legislature plans to address $103 million of it in the following way:
 $32 million in savings by not providing a SAL increase ot the courts.
 Require courts to absorb $71 million in cuts from their local reserves.
The Legislature plans to address the remaining $102 million by closing the courts to the public one day a month.  However, courts and our Locals can negotiate what this closure to the public means.  Meaning that we can negotiate to keep people working if the Local Trial Court thas money to do so and just close to the public.  SEIU attorneys have already written language to ensure our right to bargain locally is maintained and without interference from the AOC and that the impact of a closure to the public is a local decision.  So the closure doesn't necessarily have to mean a furlough.
The legislature is likely to adopt NEW transparency/accountability requirements for the AOC and some additional reporting requirements for the Trial Courts of CA.Our court campaign and member lobby days were extremely successful in helping to get nearly half of the cuts reversed, as well as helping to again defeat the Elecronic Recording proposal.
